本発明は、映画、音楽、映像、図書、コンピュータソフトウェア等に関するコンテンツを貸し出すレンタルシステム及びそのレンタル方法、サーバ装置並びにプログラムに関し、特に、インターネット等のネットワークを用いたコンテンツのレンタルシステム及びそのレンタル方法、サーバ装置並びにプログラムに関する。

【従来の技術】
従来、映画、音楽、映像、図書、コンピュータソフトウェア等に関するコンテンツの貸し出しは、レンタル店を通じて行われていた。レンタル店では、コンテンツデータが記憶されたCD、DVD、ビデオテープ等の記憶媒体を包装したパッケージを陳列し、顧客は、陳列されたパッケージの中から所望のパッケージを選択して、レンタル店内に設置された受付カウンタまで持ち込み、会員証の提示、レンタル期間の確認、レンタル料金の支払い等を行った後、レンタルすることができる。

しかしながら、この従来のレンタルシステムでは次のような課題があった。

(1)顧客としては、レンタルに際して、借りるときと返却するときの最低2回、レンタル店に来店する必要があり面倒である。

(2)レンタル店としては、多数のパッケージを陳列するスペースを備えた店舗を構える必要があり、集客効果が期待できる利便性の高い場所に店舗を設置する必要がある。また、受付等を行う従業員を採用する必要がある。そのため、レンタル店を営業するために店舗維持費、人件費等の高いコストがかかってしまう。また、在庫管理等の負担も大きい。

そこで、インターネット等のネットワークを用いてコンテンツのレンタルを行うシステムが提案されている。例えば、ネットワークを介してユーザ端末からコンテンツデータの賃借に関する注文情報を受信するセンタサーバと、注文情報に基づいて賃貸期間のみに有効な暗号鍵を生成するとともに暗号鍵を配信先端末に対して配布する配信サーバと、多数のコンテンツデータを蓄積し、配信サーバからの指示に従って配信すべきコンテンツデータを特定し、配信すべきコンテンツデータを暗号鍵にて暗号化して配信先端末に対して送信するコンテンツ蓄積サーバとを備えるたコンテンツ配信システムが提案されている。

従来のコンテンツ配信システムによれば、コンテンツデータは有効期限付きの暗号鍵によって暗号化され、配信先端末は、レンタル期間中にのみ、暗号鍵を用いてコンテンツデータの再生を行うことができる。従って、顧客は、コンテンツデータのレンタルのために店舗に来店する必要がない。

また、コンテンツ賃貸業者は、センタサーバ、配信サーバ及びコンテンツ蓄積サーバを備えることで、コンテンツデータを配信先端末に提供することができるので、店舗を構える必要がなくなる。そのため、店舗維持費や人件費等のコストや在庫管理等の負担を著しく低減できる(例えば特許文献1参照)。

【発明が解決しようとする課題】
従来のコンテンツ配信システムには次のような課題がある。

(1)会員失格が失効していても、レンタルの有効期間内であれば、レンタル中のコンテンツを再生できてしまう。

(2)利用者が不正コピーを行ったことが発覚した場合であっても、不正コピーを行った利用者を特定することが困難である。

本発明は、上記課題を解決するためになされたものであり、会員失格が失効していた場合、レンタルの有効期間内であってもコンテンツの再生を禁止することができ、不正コピーを行った利用者を容易に特定することができるコンテンツのレンタルシステム及びそのレンタル方法、サーバ装置並びにプログラムを提供することを目的とする。

以下、本発明の実施の形態について図面を参照して説明する。図1は、本発明の第1の実施形態例に係るコンテンツのレンタルシステムの構成を示すブロック図である。

なお、悪意を持った(正規)利用者によって、第三者がコンテンツを再生できるように提供したこと、又は悪意を持った利用者同士でコンテンツを頒布したことを、配信業者、警察、著作権保護支援機関等が所有するコンピュータによって自動的に認識できるようにするのが好ましい。例えば、不正コピーが流通しそうなネットワークのルートでファイルを自動収集(収集においては、配信業者のコンテンツリストからキーワードをランダムで抽出)させて、電子透かしの情報を識別させる。この場合、予め流通しそうなルートの設定や、ルート毎に異なるファイル交換プロトコルへの対応を行う必要がある。
