The embodiment of the invention provides litigation case processing methods.
Referring to FIG. 2, FIG. 2 is a schematic flow chart of an litigation case processing method according to an embodiment of the present invention.
In this embodiment, the litigation case processing method includes the steps of:
step S10, when a litigation case is received, reading litigation content of the litigation case, and determining the litigation type of the litigation case according to the file head of the litigation content;
step S20, determining place names appearing in the litigation content and the text positions of the place names in the litigation content, and determining litigation places of the litigation cases based on the place names and the text positions;
step S30, determining a corresponding lawsuit waiting attorney based on the lawsuit type and the lawsuit site, and distributing the lawsuit case to a terminal corresponding to the lawsuit waiting attorney;
step S40, if receiving instructions sent by the terminal based on the litigation case are received, determining that the attorney to be treated is a treatment attorney;
step S50, receiving and recording processing behaviors uploaded by the litigation case by the terminal, and generating case reports based on the processing behaviors.
In the embodiment, the corresponding lawsuit processing lawyer is determined according to the lawsuit type and the lawsuit place of the lawsuit case, and the corresponding processing behavior of the lawsuit case is generated into the case report, so that the matching degree of the lawsuit processing lawsuit and the lawsuit case is improved, and the source of the lawsuit case is traced.
The respective steps will be described in detail below:
step S10, when a litigation case is received, reading the litigation content of the litigation case, and determining the litigation type of the litigation case according to the file head of the litigation content.
In this embodiment, the litigation case processing method is applied to litigation case processing equipment, and for convenience of description, the litigation case processing equipment is replaced by a management platform below, the management platform can receive uploaded litigation cases, in practical application, the management platform receives litigation cases uploaded by related personnel, for example, the related personnel collects litigation cases and uploads the litigation cases according to a preset format, or the related personnel fills in related litigation contents on a litigation interface preset by the management platform.
When the management platform receives the litigation cases, the litigation content of the litigation cases is read, the litigation type and the litigation place of the litigation cases are determined through the litigation content, the file of the litigation content is read specifically, the litigation type of the litigation cases is determined according to the content of the file, in the embodiment, the litigation content of the litigation cases comprises five parts, namely the file, the litigation main body, the litigation request, the fact, the reason and the file tail, and the file specifically shows the litigation type of the current litigation cases, such as civil litigation, criminal litigation and the like, so that only the file part of the litigation content can be read in steps, and when the litigation type of the litigation cases is determined, the content needing to be read by the management platform is reduced.
Step S20, the place name appearing in the litigation content and the text position of the place name in the litigation content are determined, and the litigation place of the litigation case is determined based on the place name and the text position.
In this embodiment, the litigation content is continuously read, and specifically, the end part of the litigation content is read, and it is understood that a certain court is written in the end part of the litigation content, so that the court accepting the current litigation case can be determined through the end part of the litigation content, and the litigation place of the current litigation case can be determined. If the court appearing at the end of the text is the intermediate court in city A, the litigation site of the current litigation case can be determined to be city A.
It will be appreciated that due to litigation jurisdictional restrictions, there are situations where the court at the end of the litigation content is not the true acceptance court for the current litigation case.
Therefore, the place name appearing in the litigation content and the text position of the place name in the litigation content need to be determined, and then the litigation place of the current litigation case is determined according to the place name and the text position of the place name, specifically, the text position of the place name appearing in the litigation content includes: the litigation subject part and the ending part, the fact and reason part may or may not appear, so there are only two cases in determining the place name appearing in the litigation content and the text position of the place name in the litigation content:
, the place name only appears in the main part and the tail part of the litigation, such as divorce civil litigation, the fact and reason part only needs to write the emotional and harmonious problem, and the place name can not be related, therefore, whether the original address in the litigation main part is governed by the court of the tail can be specifically determined by comparing the place name with the place name of the court appearing in the tail, if so, the court position of the tail is determined as the litigation position of the current litigation case, if not, the original address in the litigation main part is determined as the litigation position of the current litigation case, and the tail part of the litigation content is modified through the preset court list, and the court of the tail part is specifically modified into the court to which the original address belongs, wherein the preset court list is specifically the name of each court and the jurisdiction area of each court.
Second, the place name is found in the factual and justification section, such as the car insurance claim case, in addition to the litigation main section and the postscript section, and the factual and justification section has the vehicle accident site. Therefore, whether the place name in the fact and the reason is governed by the court of the West tailed court can be determined by comparing the place name in the fact and the place name in the reason with the court place name appearing in the West tailed court, and if so, the court place of the West tailed court is determined as the litigation place of the current litigation case; if not, the place name in the fact and reason, namely the accident occurrence place, is determined as the litigation place of the current litigation case, the final part of the litigation content is modified through a preset court jurisdiction table, and the court of the final part is specifically modified into the court to which the accident occurrence place belongs, wherein the preset court jurisdiction table is specifically the names of the courts across the country and the jurisdiction areas of all the courts.
That is, the management platform can determine the litigation type and the litigation place by reading the litigation content of the litigation case, for example, by using the litigation content, the current litigation case is determined to be a civil litigation, and the litigation place is a Shenzhen city south mountain area.
Step S30, determining corresponding lawsuit attorney based on the lawsuit type and the lawsuit site, and distributing the lawsuit case to terminal corresponding to the lawsuit attorney.
In this embodiment, the management platform matches corresponding lawyers in a prestored lawyer library according to the lawyer type and the lawyer location of the litigation case, specifically, searches lawyers corresponding to the lawyer type in the lawyer library, screens out a lawyer to be processed corresponding to the lawyer location from the found lawyer, and distributes the lawyer case to a th terminal corresponding to a rd lawyer to be processed.
Before that, the lawyer needs to perform identity registration on the management platform, that is, the lawyer performs identity registration on the APP corresponding to the terminal, and specifically, the lawyer fills in relevant registration information, such as identity information, on the APP interface corresponding to the terminal and uploads relevant certification documents, such as a lawyer qualification certificate, a license of the lawyer at the office, and the like.
After completing the filling in of the APP interface corresponding to the terminal, the lawyer clicks to submit, relevant registration information is sent to the management platform, the management platform verifies the registration information after receiving the registration information submitted by the terminal, the verification mode adopts on-line verification, namely a data channel is built with a lawyer authentication mechanism, when the registration information of a lawyer is received, the registration information is compared with the data of the lawyer authentication mechanism, if the registration information passes the verification, the registration information of the lawyer is stored in a lawyer library of the management platform, if the verification fails, the information which fails the verification is sent to the terminal, wherein the information which fails the verification can include which specific registration information is filled in by mistake, and the lawyer is convenient to correct and re-register.
It should be noted that, the management platform may further perform identity division on lawyers that complete identity registration, specifically, the lawyers of the enterprise corresponding to the management platform are divided into internal lawyers, lawyers of other enterprises are divided into external lawyers, and the internal lawyers have more rights in the management platform and have litigation case priority assignment rights.
, the step S30 includes:
step a, determining a corresponding attorney pending on the basis of the litigation type and the litigation place, wherein the attorney pending comprises at least two digits.
In this step, it is understood that there may be multiple lawyers corresponding to the litigation site and the litigation cases, such as lawyer a and lawyer B for the risk claim case in area y for the litigation site, and therefore, when the attorney who is determined to be in treatment based on the litigation type and litigation site of the current litigation case includes at least two digits, the following steps are performed.
Step b, obtaining a ranking corresponding to the attorney to be processed, and determining a target attorney in the attorney to be processed according to the ranking.
In the step, attorneys can obtain initial points after completing identity registration on a management platform, and the points can be correspondingly increased or decreased along with the number and processing capacity of attorneys for processing the litigation cases, if the attorneys share case reports of the attorneys processed by the attorneys into learning cases, the points of the attorneys themselves are added, in the current practical application, the points mainly comprise two parts, namely, evaluation of the attorneys by relevant personnel and evaluation of the attorneys by the management platform, specifically, subjective evaluation is performed on the attorneys by the relevant personnel, evaluation results are uploaded to the management platform, the weight ratio is 30%, meanwhile, sets of attorneys scoring mechanisms are preset on the management platform, evaluation is performed on the amount of the attorneys receiving the cases and the time for processing the litigation cases, the weight ratio is 70%, the processing process of the actual litigation cases is considered to be long, the points of the attorneys can be updated by points by attorneys, namely, the attorneys perform evaluations on the attorneys on the points in real time, and the attorneys perform real-time evaluation on the attorneys.
Therefore, in the case that attorneys to be processed include at least two digits, the management platform obtains corresponding ranking of attorneys to be processed, and selects target attorneys from attorneys to be processed according to the ranking.
As shown in the example above, the administration platform compares the lawyer A score to the lawyer B score and preferentially distributes litigation cases to the higher scoring lawyers. Of course, litigation cases may also be randomly distributed to attorney a or attorney B in a random distribution.
And c, distributing the litigation case to the th terminal corresponding to the target lawyer.
In this step, after determining the target lawsuit, the management platform allocates the current litigation case to the th terminal corresponding to the target lawsuit, so that the th terminal displays a corresponding delegation interface for the target lawsuit to view, and specifically, displays a reminding icon at a corresponding position of the display interface of the th terminal.
Step S40, if receiving the receiving instruction sent by the terminal based on the litigation case, determining that the attorney to be treated is a treatment attorney.
In this embodiment, if a reception instruction sent by the th terminal based on the litigation case is received, representing that the pending lawyer agrees to accept the litigation case, the th pending lawyer is determined to be a processing lawyer.
It will be appreciated that attorneys have the option of waiting until attorneys send instructions to receive based on the current litigation case at terminal , the attorney is identified as a treatment attorney, and that when the attorney receives instructions to reject at terminal based on the current litigation case, the attorney is rejected, and therefore the attorney is not a treatment attorney, the attorney now assigns the current litigation case to a terminal corresponding to an attorney other than the attorney .
Step S50, receiving and recording processing behaviors uploaded by the litigation case by the terminal, and generating case reports based on the processing behaviors.
In this embodiment, after the litigation case is distributed to the terminal corresponding to the th processing lawyer by the management platform, the processing lawyer needs to record the corresponding th processing behavior on the processing interface corresponding to the th terminal by the relevant node and upload the processing behavior to the management platform, where the processing behavior includes fixed point card punching and uploading various information related to the litigation case, for example, when a court is opened, the processing lawyer needs to punch a card at a court point corresponding to the court time, upload various documents involved in the official process, report a tuning result, report mediation information corresponding to the tuning result, and the like, and the management platform receives and records the th processing behavior reported by the th terminal.
Specifically, the management platform acquires the court time of the litigation case, presets time before the court time, sends reminding information including the court time and the court place to an th terminal corresponding to a lawyer processing terminal to enable the th terminal to display the reminding information, and the reminding information is directly displayed in a display interface corresponding to the th terminal until the lawyer processing terminal clicks the terminal for confirmation.
When the management platform receives a confirmation instruction of a lawyer processing based on the reminding information through the terminal, the geographical position information and the current time of the current terminal are obtained, the geographical position information of the current terminal is compared with the court place, the current time is compared with the court time, whether the lawyer processing is in the court place at the court time is determined, if yes, the reminding information is cancelled through the terminal, if not, the reminding information cannot be cancelled, namely, after the terminal displays the reminding information containing the court time and the court place on the corresponding display interface, the display interface directly displays the reminding information, the lawyer processing cannot perform other operations on the display interface, and the reminding information cannot be cancelled at a fixed point until the lawyer processing arrives at the court place at the court time to perform card reading.
After confirming that lawyers do fixed-point card punching, the management platform obtains live court trial of the current lawsuit case through the China court trial public network so as to allow other lawyers to listen to the live trial, stores the live data, and forms a review video of the court trial so as to allow other lawyers to learn.
After court trial is finished, the management platform sends document uploading reminding information to remind a processing lawyer to upload various documents used by the current litigation case in time, after the management platform receives the various documents uploaded by the processing lawyer, a specialist of a specialist verifies the various documents, under the condition of correct verification, the score of the processing lawyer is subjected to score adding processing, if the processing lawyer refuses to upload or the uploaded various documents are wrong, such as uploading photos irrelevant to the current litigation case, the processing lawyer is subjected to score reducing processing, the management platform obtains the case number of the current litigation case, monitors the trial dynamics of the current litigation case on the basis of the case number of the current litigation case information network, and updates the trial dynamics of the current litigation case on a display interface corresponding to the terminal.
After receiving the adjustment result, the management platform generates a case report in real time based on the processing behavior, and displays the case report on a display interface of the management platform or sends the report to a second terminal for a principal or a processing lawyer and the like to consult.
The embodiment provides litigation case processing methods, when a litigation case is received, litigation contents of the litigation case are read, litigation types of the litigation case are determined according to the file of the litigation contents, place names appearing in the litigation contents and text positions of the place names in the litigation contents are determined, litigation places of the litigation case are determined based on the place names and the text positions, corresponding attorneys to be processed are determined based on the litigation types and the litigation places, the litigation case is distributed to a terminal corresponding to the attorneys to be processed, if receiving instructions sent by an terminal based on the litigation case, the attorneys to be processed are determined to be processing attorneys, the terminal is received and recorded, the litigation case is processed based on processing behaviors uploaded by the lawyes, the case processing behavior is processed, the litigation cases are processed, the litigation types of the litigatheredity cases are determined, and the case processing is processed to be processed, so that a case source report is generated and a case traceability report is generated.
, a second embodiment of the litigation case processing method of the present invention is proposed based on embodiment . the second embodiment of the litigation case processing method is different from embodiment of the litigation case processing method in that, referring to fig. 3, step S30 includes:
step S31, determining a corresponding lawyer to be processed according to the litigation type and the litigation place;
step S32, acquiring the court time of the litigation case, and determining whether the lawyer to be processed is idle or not based on the court time;
step S33, if yes, the litigation case is distributed to the terminal corresponding to the attorney to be processed.
In this embodiment, when distributing lawsuit cases to the terminal corresponding to the attorney to be treated, it is necessary to consider whether the attorney to be treated has free time to carry the lawsuit cases, so as to avoid the situation that the lawsuit cases are distributed to the terminal corresponding to the attorney to be treated, and the attorney has no time to treat.
The respective steps will be described in detail below:
step S31, determining a corresponding lawyer to be processed according to the litigation type and the litigation place.
In this embodiment, the management platform determines the corresponding th lawyer to be processed according to the litigation type and litigation place of the litigation case, which is similar to that in embodiment and will not be described herein again.
Step S32, obtaining the court time of the litigation case, and determining whether the attorney is idle or not based on the court time.
In this embodiment, after determining the st attorney to be processed corresponding to the current litigation case, first determining whether the st attorney to be processed is free, specifically determining whether the st attorney to be processed is free according to the criterion that the st attorney to be processed is free at the time of opening of the current litigation case.
Step S33, if yes, the litigation case is distributed to the terminal corresponding to the attorney to be processed.
In this embodiment, if it is determined that the st attorney is idle during the court time, indicating that the st attorney has time to process the current litigation case and can be accepted, the current litigation case is assigned to the th terminal corresponding to the st attorney.
