It has been the practice at baseball games and other places of amusement to sell or serve ice cream'in conical containers the upp'er margin of which is crimped or bentinwardly overv the upwardly extending flange of a cap or top closure plate to protect the contents of the container. In dispensing ice cream or other materials in closed conical containers ithas been-found 10 that dirt and the like very often settles in the creases and corners of thecapped container so that when a person havin a container of this type turnsthe folde upper flange outwardly to remove the cap or cover the soiled marginal portionof the container forms the rim to which the persons must apply their lips in eating the contents of the "container. 'This is every unsanitary arrangement as well as one which makes it extremely diflicult and messy for the person to try and eat the contents of theconta'iner. It is also necessary for the person as the ice cream is eaten to squeeze the lower tapered end of the container to-force the ice cream in the lower part thereof upwardly toward the rim.
This invention has'been'devised for the purpose of obviating the above objections and inconveniences in the serving and eating of ice cream from containers without the use of a spoon or the like andconsists of producing a cappedq'conical container having a plurality of spaced. circular scorings provided on the outer surface. of the container permitting the cap and upper cap holding section, to be removedfrom the zontainer to not only expose the contents there- 'of, but also affording a clean lip or edge which may be applied to a persons lip without danger of contamination. The additional spaced scorings permit the height of the container to be: reduced atintervals by consecutively tearing off sections of the-container to permit easy access to the contents thereof as well as providing a clean eating margin or lip each time the size of the cup is reduced.
It is an object of thisinvention to provide a capped conical container for the dis- "pensing of ice cream and the like, said container being provided with a plurality of spaced scorings whereby the upper capped section may first be removed to provide a clean sanita son eating rom the container.
It is also an object of this invention to provide a closed container having spaced peripheral scorings permitting the height of the container'to' be successively reduced by tearing circular sections from the container to provide a-fresh clean eating edge or lip each time a section of the container is removed. v
It is a further object of this invention to provide a conical ice cream container having a closure plate or cap secured in place in the upper portion thereof above scorings to permit the height of the container to be gradually reduced by tearing off portions of the container as the volume'of the contents of the container is reduced.
It is an important object of this invention to provide a capped conical paper container or cup provided with peripheral scorings permitting the closed upper section to be first removed from the container after which eating edge or lip for the per-- the container is adapted to be reduced in size with the reduction of the volume of this invention will be-apparent from the disclosures in the specification and the accompanying drawings.-
This invention (in a preferred form) is. illustrated i the drawings and hereinafter more fully; ribed.

As shown'on the drawings:
The reference numeral 1 indicates a conical container or cup constructed of paper or the like and formed out of a quadrantal blank having an arcuate edge and a? pair of radial edges, one of which merges with the curved edge of a tab or extension provided for -the purpose-of reinforcing the apexof ings 2 dividing the upper portion of the container into a plurality of frustum-shaped rings or sections 3 successively reduced in size as they near the apex of the container.
The upper portion of the container is provided with a plurality of closely arranged scorings 4 which separate a top section 5 from the body of the container. The top section 5 has a margin thereof bent inwardly and downwardly over the flange 6 of a cap or cover 7 whichcloses the upper portion of the container.
The container or cup is scored as described for the purpose of permitting the top section 5 and the cap 7 to be removed by tearing off said top section along one of the scorings 4. The ring sections 3 are next adapted to be successively torn off of the conical container as the contents of the container are reduced. After the contents have been reduced below the upper edge of the container formed by the scored portion 4, a person eating from the container has merely to engage a finger or thumb nail underneath the upper overlapping margin 8 forming a part of the container seam and start to tear the upper ring section 3 from the point 9 around the container to reduce the might thereof to expose the remaining contents of the container tomake the same accessible to a person desiring to eat the ice cream. The size of the container may be successively reduced predetermined amounts by successively tearlng off the ring sections 3 as the contents of the container are reduced. This arrangement permits the-contents of the container to be accessible providing a convenience to a person eating from the container.
While a plurality of circumferential grouped scorings 4 and spaced scorings 2 have been illustrated, and described as a means of reducing the height of the container to facilitate access to the contents thereof, it will, of course, be understood that a container may be provided with a spiral scoring, if desired below the scorings 4, so that the height of the container may be gradually reduced by intermittently tearing off a spiral strip of the container along the spiral scoring as the contents of the con-tainer are diminished. 1
I am aware that many changes may be made, and numerous details of construction may be varied through a wide range without departing from the principles of this invention, and I therefore do not pur ose limiting the patent granted hereon, ot ierwise than necessitated by the prior art.
I claim as my invention:
1. An ice cream dispenser or the like comprising a container constructed of a rolled quadrantal blank having a spiral overlapping margin, said container being provided with a group of adjacently disposed scorings separating the uppermargin of the container from the body portion thereof, and additional spaced scorin-gs around said body portion of the container and crossing said overlapping margin to permit the size of the cup to bereduced bystarting to tear away a portion of said cup starting at the overlapping margin thereof and following said scorings.
2. A dispenser comprising a container having a plurality of spaced scorings thereon, of a closure for said container above a plurality of grouped scorings formed in said container above said spaced scorings.
3. A dispenser comprising a capped container having a plurality of scorings therei on arranged closely adjacent one another near the upper end of the container, and a plurality of separated scorings permitting the container to be opened and reduced in size by tearing off portions thereof along said scorings.
4, A dispenser comprising a container, and a cap for closing the same, said container having a group of closely associated scorings therein directly below the cap permittingthe upper end of the container together with said cap to be removed from the container.
A dispenser comprising a container, :1 cap seated therein, said container having a group of adjacently disposed. scorings therein at a point adjacent the .cap topermit the cap and theupper margin of the con-.
tamer to be removed, said container also having a' plurality of spaced scorings around the container below the cap to permit the sizeof the container to be reduced after the removal of the upper margin and said cap.
