Abstract

The present invention provides a guide wire-catheter assembly, comprising: a catheter tube having a longitudinal channel, and a guide wire configured to be movable in the longitudinal channel characterized in that, the catheter tube comprises a bendable part near its distal end, wherein the bendable part comprises, in the circumferential direction of the catheter tube, a varying flexibility, such that exerting a longitudinal compression force in a proximal direction at a compression location distally of the distal end part results in bending of the bendable part, and in that the guide wire comprises an expandable part, wherein the expandable part is movable between a non-expanded position, in which a cross section of the expandable part is smaller than a smallest cross section of the longitudinal channel of the catheter tube and an expanded position, in which a cross section of the expandable part is larger than the smallest cross section of the longitudinal channel of the catheter tube, wherein, when the expandable part is in the non-expanded position, the guide wire can be moved completely in and out of the longitudinal channel of the catheter tube, and wherein, when the expandable part is in the non-expanded position, the expandable part is configured to exert the longitudinal compression force on the compression location in order to bend the bendable part of the catheter tube.

    2.1 Document D1 (US 2005/131343 A1: alineas [0007] - [0008], [0026], [0029] [0030], [0033], [0037] - [0039]; figuren 1-7) is regarded as being the prior art closest to the subject-matter of claim 1, and discloses:

    2.2 The subject-matter of claim 1 therefore differs from tills known device in that said draad is a ’’voerdraad·',
    2.3 The problem to be solved by the present invention may therefore be regarded as how to provide improved vasculature navigation capabilities.
    2.4 The solution proposed in claim 1 of the present application cannot be considered as involving an inventive step.
    However, these features have already been employed for the same purpose in a similar device (see D2 (EP 1 800 708 A1: alineas [0010], [0030] [0036]; figuren 3 - 7)). It would be obvious to the person skilled in the art, namely when the same result is to be achieved, to apply these features with corresponding effect to a device according to Di. thereby arriving at a device according to claim 1,
    2.5 Claim 1 is not inventive over D3 (WO 2006/119503 Al (alineas [0046] [0047], [0051], [0075] - [0076]; figuren 4 - 10, 14 -15) in the light of D4 (EP 2 393 951 Al: alineas [0003], [0020], [0023], [0028]).
    The same problem-solution approach as under items 2.3, 2,4 applies.

  3. 3 DEPENDENT CLAIMS 2 - 15
    3.1 The present application does not meet the criteria of patentability, because the subject-matter of claims 2, 3, 5, 7, 12 - 15 does not involve an inventive step.
    3.1.1 The features of dependent claims 2. 3, 5, 7, 12 -15 have already been employed for the same purpose in a similar device (see D1 (EP 1 8Q0 7G8 A1: alineas [0010], [0030] - [0036]: figuren 3 - 7)). it would therefore be obvious to the person skilled in the art to apply this feature with corresponding effect to a device according to D2, thus arriving at a device according to claim 2, 3. 5, 7, 12 ~ 15.
    3.1.2 The features of dependent claims 6, 8 have already been employed for the same purpose in a si milar device (see D5 (EP 0 689 851 Al: bladzijde 2, regel 35 - regel 59; figuren 1 - 3)). It would therefore be obvious to the person skilled in the art to apply this feature with corresponding effect to a device according to DI, thus arriving at a device according to claims 6.8.
    3.1.3 In claim 4 a slight constructional change in the device of claim 1 is defined which comes within the scope of the customary practice followed by persons skilled in the art, especially as the advantages thus achieved can readily be foreseen. Consequently, the subject-matter of claim 4 aiso lacks an inventive step.
