Abstract

A multi-storey building comprises a plurality of individual housing units. A vertical common passage with an elevator hoistway extends over several floor levels and is located directly adjacent to the exterior edge of the floor levels. A street level entrance is shared between several housing units, which is connected by a single one of the common vertical passages to several housing unit entrances on different floor levels and of which at least two housing unit entrances are located on the same floor level. The several housing units each have at least one housing unit entrance with direct access to the common passage.

    2 The present application does not meet the criteria of patentability, because the subject-matter of claim 1 is not new.
    The document 01 (see D1, especially page 7, line 18 to page 9, line 35 and fig. 1-5) is regarded as being the closest prior art to the subject-matter of claim 1 and discloses a building {Gebouw) (1) met meerdere verdiepingen (see D1, especially page 7, line 18 and fig, 5), omvattende a, een veelvoud aan individuele wooneenheden (3,4), eik begrensd door een respectievelijke begrenzing (see Dl, especially page 7, lines 18-20 and fig. 1,1a);
    b, een aantal verdiepingen waarover de wooneenheden zich uitstrekken, waarvan ten minste één verdieping is verdeeld cn er ten minste twee wooneenheden (3,4) - (see 01. especially fig. 1 1e 5);
    c, elke verdieping voorzien van een buitenrand (9) bepaald dooreen buitenkant van het gebouw (1), welke buitenrand (9) ten minste deels samenvalt met een buitengedeelte van de begrenzing van ten minste één wooneenheid (3,4) die zich over die verdieping uitsirekt (see 01, especially fig. 1,1 a,2,5);

    Consequentially the subject-matter of claim 1 is not new.
  3. 3 Dependent claims 2-22 do not contain any features which meet the requirements of novelty and/or inventive step, the reasons being as follows: Claims 2-16,19,20,21: see D1, especially fig. 1,2,3,5;
    Claim 17,18: see D1 in combination with D3, especially fig. 1,2;
    Claim 22: see D1 in combination with D2, especially claim 1 and fig. 1.

    a. Independent claim 1 is not properly cast in the two-part form, which in the present case would be appropriate, with those features known i n combination from the prior art being placed in the preamble and the remaining features being included in the characterising part;
    b. The relevant background art disclosed in the documents D1-D3 is not mentioned in the description, nor are these documents identified therein;
    c. The features of the claims are not provided with reference signs placed in parentheses.

    Claims 2,7,9,12,16,17,19 do not meet the requirements of clarity, because their subject-matter is not clear for the following reason:
    a. The expression gezamenlijke verticale doorgang as used in claim 2 is not clear and therefore is not acceptable because it lacks antecedent. Otherwise, it is not clear if the gezamenlijke verticale doorgang of claim 2 defines the same feature as the verticale gezamenlijke passage of claim 1.
    b. Due to the expression enige der voorgande conclusies” or enige van conclusies, the dependency of claims 7,9,12,16,17,19 is unclear.
