Sin embargo el dispositivo divulgado tiene el inconveniente de cubrir prácticamente todo el cuerpo del ave excepto alas y patas, suponiendo esto un gran inconveniente para la movilidad del ave, especialmente para medianas y pequeñas especies. El peso de este dispositivo y el grado de cubrición dificultan su libre movimiento y por tanto el vuelo, siendo este bajo y breve debido al notable esfuerzo adicional y consiguiente agotamiento a que se ve sometido el ave. Incluso en el citado documento se aconseja humedecer el dispositivo para refrescar al ave, dejando patente el problema de evacuación del calor, acentuado en los meses de verano. La parte inferior del dispositivo, donde está situada la cloaca, no utiliza recambios absorbentes, pudiendo ocasionar infecciones por su exposición permanente a los excrementos, si no se efectúa un lavado completo del pañal por cada deposición. La base dispone de dos cintas elásticas ajustables a modo de tirantes gracias a una hebilla corredera que las une en su parte posterior y se acoplan a la altura de las clavículas del ave, quedando la cabeza entre las cintas y dejando así el húmero completamente libre para el movimiento alar. La base dispone una abertura para permitir el paso del pigostillo, quedando la cola o plumas timoneras del ave atravesando la base y por lo tanto libres.Para facilitar su montaje y desmontaje la abertura se cierra mediante un sistema rápido de unión. Entre la base y la zona urogenital y ano del ave se dispone un absorbente reemplazable en su interior, impidiendo que el excremento y la orina se expongan a la piel, evitando enfermedades y el tener que lavar completamente el dispositivo. El objeto de la solicitud se refiere a un pañal para aves domésticas. The purpose of the application refers to a diaper for domestic birds.

La solicitud contiene doce reivindicaciones siendo la primera independiente y el resto dependientes de ella. The request contains twelve claims being the first independent and the rest dependent on it.

El problema que se desea resolver es crear un pañal para las aves de forma que interfiera lo menos posible en su movilidad. The problem to be solved is to create a diaper for birds so as to interfere as little as possible with their mobility.

La primera reivindicación divulga una base que cubre únicamente la parte trasera del ave correspondiente a la zona urogenital y ano con una abertura para permitir el paso de la cola del ave. D01 es el documento más cercano del estado de la técnica al objeto de la solicitud; en él se describe un pañal para aves con una base que cubre la parte urogenital además de la parte abdominal disponiendo también de una abertura para permitir el paso de la cola. Por ello no se considera que exista un salto inventivo importante en la solicitud respecto al estado de la técnica actual y por ello se concluye que la reivindicación 1 de la solicitud es nueva pero no tiene actividad inventiva (Art. 6.1 y Art. 8.1 LP 11/1986). La reivindicación 2 recoge el material del pañal, siendo de poliéster laminado. Este material es de uso común en la fabricación de pañales por ser impermeable y transpirable y por ello tampoco se considera que tenga actividad inventiva (Art. 6.1 y Art. 8.1 LP 11/1986). La reivindicación 3 especifica que la base se fija al ave mediante dos cintas elásticas o tirantes y en la reivindicación 12 que los tirantes llevan un sistema de amarre. El documento D01 muestra estos tirantes (308) y el sistema para acoplar una correa (120) por lo cual tampoco se considera que la reivindicación 3 ni la 12 presente actividad inventiva (Art. 6.1 y Art. 8.1 LP 11/1986). La reivindicación 11 divulga que el pañal dispone de un recambio absorbente desechable, esta característica la encontramos en el documento D02 (33) y por ello la reivindicación 11 carece de actividad inventiva (Art. 6.1 y Art. 8.1 LP 11/1986).
