Abstract

The invention relates to a continuous band for the production of basket-type bags from plastic-coated paper for fruit and vegetable produce and similar products. According to the invention, the continuous band is formed by a continuous sheet of plastic-coated paper on which rectangular plates of plastic-coated cardboard are aligned longitudinally in each of the sectors of the sheet, corresponding to the bags to be produced. Statement motivated according to articles 29.6 and 29.7 of the Regulations for the execution of Law 11/1986, of March 20, on Patents on novelty and inventive activity; quotes and explanations in support of this statement El objeto de la invención es una banda continua para la fabricación de bolsas tipo cesta para productos hortofrutícolas y similares, del tipo en el que dicha banda está destinada a cerrarse sobre sí misma, mediante la unión de sus bordes longitudinales por termo soldadura, para configurar un tubo continuo fragmentable en una pluralidad de sectores correspondientes a respectivas bolsas tipo cesta, dicha banda continua tiene una o más ventanas y, en su caso, perforaciones de igual o diferente tamaño que pueden estar cerradas con la colaboración de un fragmento de red, constituida a partir de una lamina continua de papel plastificado al menos en una de sus caras, de anchura igual a la banda continua, lamina continua de papel plastificado a la que, en correspondencia con cada uno de los sectores de la misma previstas para la obtención de una bolsa tipo cesta, se unen dos placas rectangulares de material cartón plastificado en al menos una de sus caras cuyos ejes longitudinales son paralelos al eje longitudinal de la lamina continua de papel plastificado, así mismo se disponen refuerzos de polietileno, en las zonas previstas para las asas, las termo soldaduras y, en su caso, en los bordes o periferia de las ventanas y perforaciones, unidos a la lamina de papel plastificado mediante termo soldadura o procedimiento similar. El documento D01 divulga una banda continua (1) para la fabricación de bolsas para productos hortofrutícolas y similares, del tipo en el que dicha banda (1) está destinada a cerrarse sobre sí misma, mediante la unión (6) de sus bordes longitudinales por termosoldadura, para configurar un tubo continuo fragmentable en una pluralidad de sectores correspondientes a respectivas bolsas, dicha banda continua tiene al menos una ventana (2) y perforaciones (8) de igual tamaño, estando la ventana (2) cerrada con la colaboración de un fragmento de red (4), estando la banda (1) constituida a partir de una lamina continua de plástico, de anchura igual a la banda continua, que dispone de refuerzos (5) de plástico, en las zonas previstas para las asas (11), unidos a la lamina de plástico por termo soldadura. Las perforaciones (8) del mismo tamaño se disponen paralelas al eje longitudinal de la banda, y no se encuentran tapadas por el fragmento de red (4) (descripción y figuras 1-10). La utilización de papel plastificado en lugar de plástico para la fabricación de este tipo de bolsas se encuentra ya divulgada en el estado de la técnica, como puede verse en el documento D03, obteniéndose la misma resistencia mecánica, empleando menos plástico y disponiendo además de espacio para la impresión en las propias bolsas. Por ello esta diferencia como tal, carece de actividad inventiva. La diferencia entre el documento D01 y el contenido de la reivindicación 1 es que en el primero de ellos no se disponen las dos placas rectangulares de material cartón plastificado en al menos una de sus caras con sus ejes longitudinales paralelos al eje longitudinal de la lámina continua, en correspondencia con cada uno de los sectores de la misma previstos para la obtención de una bolsa. El efecto técnico asociado a esta diferencia es que la banda continua en cada uno de los sectores que la conforman, puede adoptar la forma de cesta, dado el soporte estructural que dichas láminas de cartón les proporciona. Sin embargo, esta diferencia así como el efecto técnico que lleva asociado se encuentran recogidos dentro del documento D02, en el que se divulga la utilización de refuerzos de cartón, que dispuestos en el exterior o interior de las bolsas, otorgan a estas una fortaleza estructural que permite que adopten configuraciones diversas (descripción y figuras 1-9). Para un experto en la materia resultaría evidente la aplicación de estos refuerzos de cartón a las bandas continuas divulgadas en el documento D01 en correspondencia con cada uno de los sectores que las componen, con el fin de permitir que a partir de cada uno de estos sectores se pueda generar bolsas con configuraciones determinadas, como por ejemplo cestas. En relación a las reivindicaciones 2-3 se hace referencia en ellas a unas dimensiones que no producen un efecto técnico diferente y novedoso con respecto a dimensiones del mismo orden que estas. La reivindicación 4 hacen mención a un sistema técnico de unión sobradamente conocido en el estado de la técnica y cuyo efecto técnico es el mismo que se podría conseguir mediante otras técnicas igualmente conocidas. En relación a la reivindicación 5, la utilización de cartón plastificado, ya sea por una o por las dos caras, en el interior de la banda continua, no parece tener efecto técnico novedoso o diferente al producido por una lámina de cartón sin plastificar. En relación a la reivindicación 8, la utilización de una tira continua de red, o la utilización de fragmentos unitarios que tapen las correspondientes ventanas en cada uno de los sectores que componen la banda continua, es una opción técnica que nuevamente parece no tener un efecto técnico novedoso añadido. Además, esta opción técnica se recoge ya en el estado de la técnica, como puede verse en el documento D02 (figura 5).
