Statement motivated according to articles 29.6 and 29.7 of the Regulations for the execution of Law 11/1986, of March 20, on Patents on novelty and inventive activity; quotes and explanations in support of this statement En el estado de la técnica analizado se ha encontrado algunos documentos que afectan la actividad inventiva de algunas de las reivindicaciones de la solicitud. A continuación se comentan los más cercanos (D01, D02 y D03). En D01 se presenta un aparato frigorífico con una pareja de contenedores, a modo de cajón, para almacenar productos tales como vegetales y frutas (17 y 18). Se considera que todas las características técnicas de las reivindicaciones 1 a 3, 5 y 7 a 11 de la solicitud presentada, o bien se encuentran como tal en D01, o bien se deducen de una manera evidente para un experto en la materia en vista de D01. Dichas características técnicas son (las referencias corresponden a D01): contenedor (17 y 18), deslizable sobre la bandeja (16) y con guías laterales (27 y 28). Cada guía dispone de una pared superior y una inferior (ver figura 2), comprendiendo cada contenedor un nervio longitudinal a cada lado (ver figura 2), que se aloja en las ranuras de las guías. Asimismo, la bandeja (16) comprende un saliente a modo de tope que limita el desplazamiento horizontal del contenedor (ver, en figura 2, dicho tope en la parte anterior de las guías). También dispone de un tope que limita el desplazamiento horizontal del segundo contenedor hacia el interior de la cavidad interior (ver columna 2, líneas 45 a 50). El hecho de que el aparato frigorífico presente dos contenedores, uno inferior y otro superior se considera que no forma parte del objeto de la invención y además es fácilmente deducible para un experto en la materia (ver por ejemplo figura 1 de D02), así como que la bandeja y las guías formen una sola pieza (ver figuras 2 y 3 de D03). Las reivindicaciones 7 a 11 se consideran evidentes para un experto en la materia en el campo de los aparatos frigoríficos, ya que describen soluciones técnicas comunes en dicho campo, y, por tanto, carecen de actividad inventiva. Por todo lo anterior, se puede afirmar que las reivindicaciones 1 a 3 y 5 a 11 de la solicitud presentada carecen de actividad inventiva según el artículo 8 de la ley 11/1986 de Patentes. Sin embargo, no se han encontrado documentos que anulen la actividad inventiva de la reivindicación 4, con lo que dicha reivindicación sí posee actividad inventiva. Each guide has an upper and a lower wall (see figure 2), each container comprising a longitudinal rib on each side (see figure 2), which is housed in the grooves of the guides. Also, the tray (16) comprises a projection as a stop which limits the horizontal movement of the container (see, in figure 2, said stop in the front part of the guides). It also has a stop that limits the horizontal displacement of the second container into the interior cavity (see column 2, lines 45 to 50). The fact that the refrigerating apparatus has two containers, one lower and one upper is considered not part of the object of the invention and is also easily deductible to a person skilled in the art (see for example figure 1 of D02), as well as the tray and guides form a single piece (see figures 2 and 3 of D03). Claims 7 to 11 are considered obvious to one skilled in the art in the field of refrigeration appliances, since they describe common technical solutions in said field, and therefore lack inventive activity. For all the foregoing, it can be affirmed that claims 1 to 3 and 5 to 11 of the filed application lack inventive activity according to article 8 of Patent Law 11/1986. However, no documents have been found to nullify the inventive activity of claim 4, whereby said claim does possess inventive activity.
