In the embodiment of the invention, the system further comprises a client terminal accessed to the cloud center, wherein the receiving client terminal judges whether the current task to be executed relates to intellectual property information recorded in a preset intellectual property right information base before receiving the licensing request sent by the client terminal, and if so, the receiving client terminal sends a reminding message or sends the licensing request to the cloud center so that the cloud center completes an intellectual property right licensing transaction event according to the received licensing request to obtain a corresponding licensing certificate; and in the task execution process, the receiving client terminal monitors whether the execution operation of the task exceeds the permission range recorded by the obtained permission certificate in real time, and if so, generates alarm information and feeds the alarm information back to the cloud center.
The client terminal runs in the intelligent equipment accessed to the Internet of things, and can interact with the cloud center to complete the discovery and execution functions of the client terminal. The client terminal comprises a license discovery component and a license execution component. The license discovery component determines, based on the task to be performed by the device, whether the task falls within the scope of protection of the known property or properties recorded in the intellectual property licensing system of the present invention. If yes, a prompt is sent out or a permission inquiry/request is automatically sent out to the cloud center according to the rule configured by the client terminal, and a permission certificate obtained by the permission record according to the content of the permission electronic contract is obtained. The license execution component sends an instruction whether to execute a corresponding task to the equipment according to the intellectual property license certificate acquired by the license discovery component, and is responsible for monitoring the process of executing the task by the equipment in real time so as to ensure that the range of executing the task by the equipment is based on the license range of the license certificate, if the range of executing the task by the equipment exceeds the range of the license certificate, the equipment is prohibited from continuously executing the task, and if the equipment exceeds the range of the license certificate for other reasons and executes an infringement task, the license execution component generates warning information and feeds back all the information to the cloud center in time.
In an embodiment of the present invention, the system further includes an application unit, where the application unit runs in a cloud or other computing environment, and mainly but not limited to providing an open application service based on or serving a licensing system, such as an intellectual property database, statistical analysis, licensing source and communication promotion. The application unit comprises an interface system and a service system. The interface subsystem provides the third party application developer with the interactive interface of the system of the invention, so that the third party application developer can develop the independent application program based on the capability of the system. The interface system includes an interface authentication component and an API gateway. The service subsystem faces users and third-party service providers, provides related services based on the system for the users, and provides services integrating the service capacity of the third-party service providers into the system for the third-party service providers, such as intellectual property databases, intellectual property service products, other commercial databases and other commercial service products. The service subsystem comprises a service application component facing a user, a development tool kit facing a third-party service provider and a corresponding data interface.
For the system embodiment, since it is basically similar to the method embodiment, the description is simple, and for the relevant points, refer to the partial description of the method embodiment.
According to the intellectual property licensing method and system based on the Internet of things, the automatic realization of the value of the intellectual property is realized under the background of the Internet of things and intelligent manufacturing, the protection of the intellectual property is extended to a manufacturing end, the intellectual property is protected before infringement occurs, and even infringement behaviors are fundamentally stopped to a certain extent; meanwhile, an online, automatic and all-weather intellectual property right license acquisition and transaction mechanism is constructed, the cost for acquiring the intellectual property right license is greatly reduced, and a channel for realizing the value of the intellectual property right are widened. The method really reflects the value of the intellectual property, changes the major trend of the manufacturing industry along with the interconnection and intelligent manufacturing of the everything of the Internet of things, achieves deep integration into industrial operation and social economy, and also reflects the value of the intellectual property to realize digitization and intellectualization.
Furthermore, an embodiment of the present invention also provides a computer-readable storage medium, on which a computer program is stored, which when executed by a processor implements the steps of the method as described above.
In this embodiment, the module/unit integrated with the intellectual property licensing system based on the internet of things may be stored in a computer readable storage medium if it is implemented in the form of a software functional unit and sold or used as an independent product. Based on such understanding, all or part of the flow of the method according to the embodiments of the present invention may also be implemented by a computer program, which may be stored in a computer-readable storage medium, and when the computer program is executed by a processor, the steps of the method embodiments may be implemented. Wherein the computer program comprises computer program code, which may be in the form of source code, object code, an executable file or some intermediate form, etc. The computer-readable medium may include: any entity or device capable of carrying the computer program code, recording medium, usb disk, removable hard disk, magnetic disk, optical disk, computer Memory, Read-Only Memory (ROM), Random Access Memory (RAM), electrical carrier wave signals, telecommunications signals, and software distribution media, etc. It should be noted that the computer readable medium may contain content that is subject to appropriate increase or decrease as required by legislation and patent practice within jurisdictions, for example, in some jurisdictions, computer readable media may not include electrical carrier signals and telecommunications signals in accordance with legislation and patent practice.
Fig. 3 is a schematic diagram of a computer device according to an embodiment of the present invention. The computer device provided by the embodiment of the present invention includes a memory 301, a processor 302, and a computer program stored in the memory 301 and executable on the processor 302, where the processor 302 executes the computer program to implement the steps in the above-mentioned embodiments of the method for licensing intellectual property rights based on the internet of things, for example, step S11 shown in fig. 1, after authenticating the rights of the user, the electronic contract is generated according to a preset contract template for the intellectual property right license contract uploaded by the user with the specified rights. And step S12, converting the generated electronic contract into a coded executable electronic contract and deploying the executable electronic contract. And step S13, issuing contract information of the executable electronic contract for the accessed client terminal to execute permission. When receiving the license request sent by the client terminal, step S14 finds an executable electronic contract matching the license request in the currently issued executable electronic contracts. And step S15, executing the searched executable electronic contract to trigger the transaction event of the permission of the knowledge yield, updating the corresponding contract information according to the execution result, and returning the permission certificate obtained after the execution to the client terminal. Alternatively, the processor 302, when executing the computer program, implements the functions of the modules/units in the above-mentioned embodiments of the internet-of-things-based intellectual property licensing system, such as the contract generating component 201, the contract deploying component 202 and the contract licensing component 203 shown in fig. 2.
Illustratively, the computer program may be partitioned into one or more modules/units that are stored in the memory and executed by the processor to implement the invention. The one or more modules/units may be a series of computer program instruction segments capable of performing certain functions, which are used for describing the execution process of the computer program in the intellectual property licensing system based on the internet of things. For example, the computer program may be partitioned into a contract generation component 201, a contract deployment component 202, and a contract licensing component 203.
The computer equipment can be desktop computers, notebooks, palm computers, cloud servers and other computing equipment. The computer device may include, but is not limited to, a processor, a memory. It will be appreciated by those skilled in the art that the schematic diagram 3 is merely an example of a computer device and is not intended to limit the computer device, and may include more or less components than those shown, or some components may be combined, or different components, for example, the computer device may also include an input output device, a network access device, a bus, etc.
The Processor may be a Central Processing Unit (CPU), other general purpose Processor, a Digital Signal Processor (DSP), an Application Specific Integrated Circuit (ASIC), a Field-Programmable gate array (FPGA) or other Programmable logic device, discrete gate or transistor logic device, discrete hardware component, etc. The general purpose processor may be a microprocessor or the processor may be any conventional processor or the like which is the control center for the computer device and which connects the various parts of the overall computer device using various interfaces and lines.
The memory may be used to store the computer programs and/or modules, and the processor may implement various functions of the computer device by running or executing the computer programs and/or modules stored in the memory and calling data stored in the memory. The memory may mainly include a storage program area and a storage data area, wherein the storage program area may store an operating system, an application program required by at least one function (such as a sound playing function, an image playing function, etc.), and the like; the storage data area may store data (such as audio data, a phonebook, etc.) created according to the use of the cellular phone, and the like. In addition, the memory may include high speed random access memory, and may also include non-volatile memory, such as a hard disk, a memory, a plug-in hard disk, a Smart Media Card (SMC), a Secure Digital (SD) Card, a Flash memory Card (Flash Card), at least one magnetic disk storage device, a Flash memory device, or other volatile solid state storage device.

Claims (6)

1. An intellectual property licensing method based on the Internet of things is characterized by comprising the following steps:
after the authority of the user is authenticated, generating an electronic contract for an intellectual property licensing contract uploaded by the user with the appointed authority according to a preset contract template;
converting the generated electronic contract into a coded executable electronic contract and deploying the executable electronic contract;
issuing contract information of the executable electronic contract for the accessed client terminal to execute permission;
when a permission request sent by a client terminal is received, searching an executable electronic contract matched with the permission request in the currently issued executable electronic contracts;
executing the searched executable electronic contract to trigger an intellectual property right license transaction event, updating corresponding contract information according to an execution result, and returning a license certificate obtained after execution to a client terminal;
after the intellectual property right licensing transaction event is triggered, providing payment and settlement service for the transaction event according to the transaction price corresponding to the executable electronic contract;
recording and updating user information of a party corresponding to the transaction event; after the converting the generated electronic contract into a coded executable electronic contract, the method further comprises:
setting a transaction price and associated product information for the executable electronic contract according to a user instruction of the user or according to a preset pricing rule; before the client terminal sends the permission request, the method further comprises:
the client terminal judges whether the current task to be executed relates to intellectual property information recorded in a preset intellectual property information base, if so, the client terminal sends a reminding message or sends an admission request to a cloud center so that the cloud center can complete an intellectual property admission transaction event according to the received admission request to obtain a corresponding admission certificate;
and the client terminal monitors whether the execution operation of the task exceeds the permission range recorded by the obtained permission certificate in real time in the task execution process, and if so, generates alarm information and feeds the alarm information back to the cloud center.
2. The method of claim 1, further comprising:
receiving a query request of a client terminal or an external application program interface, wherein the query request carries query field information;
searching intellectual property information matched with the query field information in a preset intellectual property information base;
and sending the searched intellectual property information to a corresponding client terminal or an external application program according to a specified format.
3. The method of claim 1, further comprising:
when the intelligent equipment is accessed, the safety of the intelligent equipment is verified, and a request session communication link is established after the verification is passed;
and logging the equipment access event.
4. The method of claim 1, wherein the deploying the executable electronic contract comprises:
and deploying the executable electronic contract according to a block chain technology.
5. The method of claim 1, wherein the issuing contract information for the executable electronic contract comprises:
and recording the contract information of the executable electronic contract, and issuing the contract information of the executable electronic contract according to a preset rule after the user confirms the contract information.
6. An intellectual property licensing system based on the internet of things, comprising:
the contract generation component is suitable for generating an electronic contract for the intellectual property licensing contract uploaded by the user with the appointed authority according to a preset contract template after the authority authentication is carried out on the user;
a contract deployment component adapted to convert the generated electronic contract into a coded executable electronic contract and deploy the executable electronic contract;

the payment and settlement component is suitable for providing payment and settlement service for the transaction event according to the transaction price corresponding to the executable electronic contract after triggering the intellectual property licensing transaction event;
the account component is suitable for recording and updating the user information of the party corresponding to the transaction event;
the client terminal judges whether the current task to be executed relates to intellectual property information recorded in a preset intellectual property information base, if so, the client terminal sends a reminding message or sends an admission request to a cloud center so that the cloud center can complete an intellectual property admission transaction event according to the received admission request to obtain a corresponding admission certificate;
